By accessing or using EcoNative Garden Mentor ("Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

EcoNative Garden Mentor is a mobile application that helps users:

• Identify plants using AI-powered photo analysis
• Get personalized native plant recommendations based on your location
• Track your garden's health and growth
• Receive care tips and seasonal advice
• Connect with a community of native plant enthusiasts

3. User Accounts

3.1 Account Creation

You may create an account using your email address or through supported social login providers. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Anonymous Usage

You may use certain features without creating an account ("anonymous mode"). Features are limited in anonymous mode, and data may not be preserved if you uninstall the app without creating an account.

3.3 Age Requirements

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

4. Subscriptions and Payments

4.1 Free and Premium Tiers

EcoNative offers both free and premium subscription tiers:

• Free Tier: Limited to 3 plant check-ins per week
• Bronze: Monthly subscription with unlimited check-ins
• Gold: Annual subscription with premium features
• Founding Gardener: Lifetime access for early supporters

4.2 Billing

All payments are processed through the Apple App Store or Google Play Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

4.3 Refunds

All refunds are handled by Apple or Google according to their respective refund policies. We cannot process refunds directly.

5. User Content

5.1 Your Content

You retain ownership of photos and other content you submit to the Service. By submitting content, you grant us a non-exclusive, worldwide license to use, process, and store your content for the purpose of providing the Service.

5.2 Content Guidelines

You agree not to submit content that:

• Violates any applicable laws or regulations
• Infringes on intellectual property rights
• Is harmful, threatening, or harassing
• Is unrelated to gardening or plant identification

6. AI-Powered Features

6.1 Plant Identification

Our AI-powered plant identification uses third-party services (Google Gemini and xAI Grok) to analyze photos. While we strive for accuracy, plant identifications are provided for informational purposes only and should not be relied upon for safety-critical decisions (e.g., determining if a plant is edible or toxic).

6.2 Care Recommendations

Care tips and recommendations are generated using AI and general horticultural knowledge. Results may vary based on your specific conditions. Always research specific care needs for your plants.

7. Location Data

With your permission, we collect location data to determine your USDA hardiness zone and ecoregion. This helps us provide accurate, native-first plant recommendations. Location data is never shared with third parties for marketing purposes.

8. Intellectual Property

The Service and its original content (excluding user-submitted content), features, and functionality are owned by EcoNative and are protected by international copyright, trademark, and other intellectual property laws.

9. Limitation of Liability

To the maximum extent permitted by law, EcoNative shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from:

• Your use or inability to use the Service
• Any inaccurate plant identification or care advice
• Unauthorized access to your account or data
• Any third-party content or conduct

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the new Terms on this page and updating the "Last updated" date.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
